The Panel's report of 3 April 2020 on Amendment C394ggee quotes the Portarlington Structure Plan: Portarlington's location on the Bellarine Peninsula makes it susceptible to climate change impacts, particularly the low-lying areas in the western and eastern parts. It also records that the area around Turner Court and south of Franzel Avenue is not identified in the Structure Plan as subject to inundation but is proposed to be included in the overlay, so the plan alone does not tell you which streets are mapped. Amendment C394ggee was gazetted on 3 September 2020 and names Portarlington among the localities it affects.
The second control is the Special Building Overlay. Amendment C265, gazetted on 15 October 2015, says the land affected includes land subject to overland flows resulting from storm events in Corio, Newcomb, Whittington and Portarlington East. The City's frequently asked questions for a later amendment say, of overlays of this kind, that usually no provision was made for overland flows, so land is often flooded when the capacity of the underground drainage system is exceeded. That sentence is general, not a finding about Portarlington. Ask the City whether either overlay applies to the address and whether filling in a pool, or any change to the finished level, needs a permit.
